- Assault is the threat of imminent harm or contact. California law defines an assault as an unlawful attempt, coupled with a present ability, to commit an injury on the person of another. No contact between the alleged aggressor and the victim has to take place — only the threat of contact.
- Battery is a completed assault. California law defines battery as any willful and unlawful use of force or violence upon the person of another. There must have been contact between the alleged aggressor and the victim to constitute a battery, although the contact can be minor.
