Robert Downey Jr.'s son accused of drug possession in California

Those in California may assume that nonviolent crimes are not punished as harshly as ones that do involve violence. This is not always the case, as prosecutors always consider drug crimes to be serious. Someone who is convicted of drug possession could face a range of punishments, including fines or incarceration. This is the problem that faces the son of actor Robert Downey Jr., Indio, who was recently charged with two drug-related offenses here in California.

Authorities say that Indio Downey was a passenger in a car that was pulled over by a sheriff’s deputy. The officer claims that Downey had a smoking pipe and a drug that seemed to be cocaine. He was arrested and charged with felony possession of a controlled substance and misdemeanor possession of drug paraphernalia.

Though Downey has not yet been arraigned, his famous father publicly stated that he was thankful that his son had been arrested. Robert Downey Jr. says it brings his son’s possible addiction to light, giving the family more of a chance to help the young man fight it. In the past, he has been open about his own struggles with drug addiction.

Despite Robert Downey Jr.’s public support of his son, it is worth noting that Indio Downey is presumed innocent in the eyes of the law, until and only if proven guilty of the charges he faces. Anyone here in California who is charged with drug possession has the legal right to defend him- or herself against the accusations in court. A full understanding of one’s options and the laws that encompass a particular crime may provide the foundation for a criminal defense geared toward achieving the best result possible, including even a dismissal in certain cases.
