3 Californians arrested on suspicion of date-rape drug sales

Police have heightened their interest in the so-called "date-rape drugs" in California. Generally, the main culprit is a chemical called GHB. However, there are similar versions of the same synthetic narcotic on the market that supposedly have a similar effect. Roseville police arrested three people recently on suspicion of drug sales of a drug with similar effects to GHB.  

Police say their investigation led them to a house in Rancho Cordova where they served a search warrant on Dec. 9. They report that they found a large quantity of the drug inside, packaged and disguised in the form of a massage oil. They say they also found $20,000 in cash, firearms and methamphetamine, along with various indicia of drug trafficking.

Authorities say they found a large supply of the drug at another related location. They report to seizing a total of 22 gallons of the substance. Arrested on numerous drug charges were a 74-year-old male, a 42-year-old female and a 40-year-old male, all residents of Rancho Cordova.

Each criminal defense counsel will want to first examine all of the circumstances surrounding the arrest and get a thorough account of the facts from the client and any available witnesses. The first inquiry is often to determine whether the search warrant was validly obtained and whether constitutional protections were provided. The warrant may have been sworn out, for example, on the basis of unreliable or irrelevant third party information.

In this case, counsel will also want to look closely at the lab reports on the chemical seized. It's always possible that the chemical substance, which physically appears to be massage oil, is actually massage oil. That potential defense must be closely examined and ruled out only if there are no valid claims that might assist the defense in challenging the drug sales charges. California defense counsel will also want to determine whether his or her client was directly involved in the activities involving the chemical or whether the individual was merely at the wrong place at the wrong time.
